Terms of Use
These Terms of Use (the "Terms") govern your relationship with Iuvenalii Khlopkov (PE) (the "Provider") regarding use of the 12levels mobile application (the "Service"). By using the Service you fully and unconditionally accept these Terms.
These Terms incorporate by reference our Privacy Policy and Subscription Terms, which form an integral part of these Terms. By using the Service you accept all three documents.
1. License Grant
The Provider grants you a non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial English language learning.
2. Description of the Service
The Service is a mobile application for learning English as a foreign language. The Provider may add, remove, or modify any specific feature within the Service at any time at its sole discretion; the authoritative list of features currently available is the one shown inside the application and on the App Store product page. Changes to the feature set do not affect the validity of these Terms.
3. Account and Registration
To access full functionality you need to register. You agree to:
- Provide accurate registration data
- Not share your credentials with third parties
- Not create multiple accounts to circumvent restrictions
- Promptly notify us of any account compromise
You may delete your account at any time via Profile → Delete Account. After deletion, your data is removed within 30 days (see Privacy Policy for details). Deleting your account does not automatically cancel any active Apple subscription — see Section 4.
4. Paid Plans and In-App Purchases
The Service offers various paid plans through Apple's In-App Purchase system, including auto-renewable subscriptions and one-time non-consumable purchases. The specific plans available, their billing cycles, prices, and the availability and duration of any free trial or introductory offers are displayed dynamically within the Service and on the App Store product page before purchase.
Detailed rules governing pricing, billing cycles, free-trial mechanics, auto-renewal, cancellation, refund handling, and other subscription- specific matters are set out in the separate Subscription Terms document, which forms an integral part of these Terms. By starting any paid plan you accept the Subscription Terms in addition to these Terms.
Key points (full text in the Subscription Terms):
- All charges are processed by Apple; the Provider does not see or store payment instruments.
- Auto-renewable subscriptions renew automatically unless cancelled at least 24 hours before the current period ends.
- You can cancel any active subscription in Settings → [your name] → Subscriptions on iOS, or via Profile → Manage Subscription inside the app.
- Refunds are handled by Apple at reportaproblem.apple.com; mandatory consumer protection rights in your country are preserved.
- Family Sharing is not enabled in this version.
5. Intellectual Property
All rights to the Service, including code, design, text, audio, and trademarks, belong to the Provider or its licensors. You receive only the right to use the Service in accordance with these Terms.
6. Prohibited Conduct
You agree not to:
- Copy, distribute, sell, or transfer Service content to third parties
- Decompile, disassemble, or modify the source code
- Use the Service for unlawful activities
- Disrupt the Service (DDoS, scraping, API overload)
- Create derivative products based on content of the Service
- Submit malicious content (viruses, malware) to the Service
- Use chargebacks or fraudulent refund claims to obtain "12levels Pro" features without paying
- Submit text prompts, free-text input, or any other user-generated content that is illegal, harmful, harassing, sexually explicit, hateful, defamatory, infringing, or otherwise prohibited by the acceptable use or usage policies of any third-party provider used by the Service (including, but not limited to, the policies of any AI providers the Service may rely on). Violation may result in immediate suspension of access without refund.
- Attempt to manipulate, jailbreak, or bypass safety filters of any AI models used by the Service through prompt injection, adversarial inputs, or other techniques.
7. AI-Generated Content
The Service uses artificial intelligence to generate personalized stories and explanations. You understand and accept that:
- AI-generated content may contain inaccuracies, factual errors, or unusual phrasing
- The Service does not guarantee uniqueness of generated content
- The Service is not responsible for the content of generated material
- Use of AI-powered features may involve transmission of anonymized learning context to external providers (see Privacy Policy §5.2)
8. Educational Outcomes
The Service provides tools for learning English. The Provider does not guarantee that you will achieve any specific level of language proficiency — outcomes depend on regular practice, time invested, and individual ability.
9. Liability and Warranty Disclaimer
Disclaimer of Warranties. The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. The Provider does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
To the maximum extent permitted by law, the Provider is not liable for:
- Indirect or consequential damages, lost profits
- Temporary unavailability of the Service (including planned maintenance)
- Data loss caused by user-side or third-party failures (Apple, Cloudflare, Supabase)
- Actions of third parties who gained account access through user fault
Total liability is limited to the subscription fees paid in the last 12 months (or the Lifetime purchase price, if applicable). Mandatory consumer protection rights in your country of residence remain unaffected.
10. Changes to Terms
The Provider may modify these Terms. Material changes will be announced in the app and may require renewed acceptance. Continued use after changes means you accept them.
11. Termination
These Terms remain in effect until terminated by either party. The Provider may terminate the agreement and block your account for material breach, including fraudulent purchase activity or repeated chargebacks. Termination by the Provider for cause does not entitle you to a refund except where required by law or by Apple's policies.
12. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Armenia, with mandatory consumer protection provisions of your country of residence remaining applicable.
Disputes shall be resolved through negotiations. Failing that, by court at the Provider's place of registration or — for consumer disputes — at your place of residence at your option.
13. Apple App Store Additional Terms
The following terms apply to the version of the Service distributed through Apple's App Store and are in addition to (and, where directly conflicting, supersede) the rest of these Terms:
- Acknowledgement. These Terms are concluded solely between you and the Provider, not with Apple Inc. The Provider, not Apple, is solely responsible for the Service and its content.
- Scope of license. The license granted to you for the Service is limited to a non-transferable license to use the Service on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Maintenance and support. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Service. Any questions concerning the Service should be directed to the Provider at the contact details below.
- Warranty. The Provider, not Apple, is solely responsible for any warranty obligations regarding the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service (if applicable). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Service.
- Product claims. The Provider, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of the Service, including but not limited to: (i) product-liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
- Intellectual-property claims. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual-property rights, the Provider, and not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. You acknowledge and agree that Apple Inc. and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
14. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy and the Subscription Terms, constitute the entire agreement between you and the Provider with respect to the Service, and supersede any prior agreements, communications, or proposals — whether oral, written, or electronic — between you and the Provider regarding the Service.
16. No Waiver
The failure of the Provider to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed (or electronically acknowledged) by the Provider.
